Terms of Service Agreement
Please read this Agreement carefully before using our services.
This Agreement is entered into between HahuCloud Technologies PLC ('Company') and the individual or entity accessing or using HahuCloud's services ('Customer'). By registering for, purchasing, or using any HahuCloud service, you acknowledge that you have read, understood, and agree to be bound by the terms set out below.
1. Introduction
These Terms of Service ('Agreement') govern the provision by HahuCloud Technologies PLC ('Company', 'we', 'us', or 'our') of the services and/or products described in the applicable Service Descriptions. By purchasing or using any of our services, you ('Customer', 'you', or 'your') agree to be bound by this Agreement in full. HahuCloud Technologies PLC reserves the right to amend this Agreement at any time. Continued use of our services following any such amendment constitutes your acceptance of the revised terms.
2. Disk Space and Bandwidth
Customers are allocated disk space and bandwidth in accordance with their selected hosting plan. Usage is actively monitored by the Company. Customers are solely responsible for ensuring their usage remains within the limits of their plan and for upgrading their plan as required. Sustained excessive usage may necessitate a plan upgrade or result in additional usage charges at the Company's discretion.
3. File Storage and Online Backups
The Company's shared hosting services are provided exclusively for the purpose of genuine web hosting. The use of shared hosting resources for general file storage, large multimedia content, backup repositories, or third-party storage applications (including but not limited to OwnCloud) is strictly prohibited. Email archival systems are not permitted on shared hosting infrastructure. Allocated disk space is considered unlimited only where the substantial majority of usage is attributable to active web hosting content.
4. Free Domain Terms
Customers who purchase an eligible hosting package from the Company may receive a complimentary domain registration, subject to the terms and conditions specified within their hosting plan. The free domain offer is limited to domain extensions listed in the applicable plan and remains valid only for so long as the associated hosting package is maintained and renewed with the Company.
One free domain registration is permitted per hosting plan. The domain extension selected must correspond to those specified in the plan. To qualify, the domain and hosting package must be purchased concurrently. Domains registered separately from the hosting package are not eligible for the free domain offer.
In the event that a customer cancels or fails to renew their hosting package, the customer becomes solely responsible for all applicable domain registration and renewal fees required to maintain ownership of the domain. Additional domain-related services may incur charges in accordance with the Company's prevailing pricing policies.
5. Audio and Video Streaming
The streaming of audio or video content hosted on the Company's infrastructure is strictly prohibited. Accounts found to be in violation of this policy are subject to immediate suspension or termination without prior notice.
6. Prohibited Content and Websites
The Company does not permit the hosting of the following content or website types on its platform: adult or sexually explicit content; content that distributes or facilitates illegal materials or infringes upon intellectual property or copyright laws; file hosting or distribution services; video tube or streaming sites. The Company reserves the right to make final determinations regarding content compliance and to suspend or terminate accounts found to be in breach of this policy.
7. Copyright and Intellectual Property
The Company assumes no responsibility or liability for copyright infringements arising from content uploaded, published, or otherwise hosted on its servers by customers. Customers are solely responsible for ensuring that all content hosted through the Company's services complies with applicable copyright and intellectual property laws.
8. Suspension and Termination
Hosting services will be suspended where an account balance remains outstanding for a period exceeding three (3) days from the due date. Accounts that remain unpaid for ten (10) or more days are subject to permanent termination. The Company reserves the right to refuse service to any customer with a history of repeated non-payment or violation of these Terms.
9. Domain Expiry
All domain registrations are subject to annual renewal. Reminder notifications will be dispatched to the email address registered on your account prior to the expiry date. It is the customer's sole responsibility to maintain accurate and current contact information. The Company accepts no liability for failed renewals arising from incorrect or outdated account details.
Failure to renew a domain prior to its expiry date will result in the immediate suspension of all associated services. Following expiry, the domain enters a fifteen (15) day grace period during which renewal may be completed at the standard renewal rate. Upon conclusion of the grace period, the domain enters a thirty (30) day redemption period; recovery during this time remains possible but is subject to an additional redemption fee levied by the registry — this fee is variable and not fixed by the Company, please contact hello@hahucloud.com for a current quote. Following the redemption period, the domain enters a five (5) day pendingDelete status during which no action whatsoever can be taken by any party. The domain will then be permanently cancelled and released for public registration.
The Company does not guarantee the renewal or recovery of any domain name once it has passed its expiry date. Once released, the domain may be acquired by any third party worldwide and the Company assumes no control over or claim to it.
For details regarding the Company's notification obligations and the limits thereof, refer to Section 10 (Notification Procedures) of this Agreement.
10. LIMITATION OF LIABILITY
THE COMPANY'S SERVICES, INCLUDING BUT NOT LIMITED TO WEB HOSTING, DOMAIN REGISTRATION, AND RELATED INFRASTRUCTURE, ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. THE COMPANY DOES NOT WARRANT THAT ITS SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM SECURITY VULNERABILITIES. NO GUARANTEE IS MADE REGARDING UPTIME, DATA INTEGRITY, OR THE PRESERVATION OF ANY CONTENT HOSTED ON THE COMPANY'S SERVERS. NOTWITHSTANDING THE FOREGOING, WHERE THE COMPANY AND CUSTOMER HAVE EXECUTED A SEPARATE SERVICE LEVEL AGREEMENT ('SLA'), THE TERMS OF THAT SLA SHALL GOVERN UPTIME, AVAILABILITY, AND RELATED REMEDIES TO THE EXTENT THEY CONFLICT WITH THIS SECTION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE HELD LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE CUSTOMER'S USE OF, OR INABILITY TO USE, THE SERVICES. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF REVENUE, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, WEBSITE DOWNTIME, OR DAMAGE TO REPUTATION, PROVIDED THAT SUCH LOSSES WERE NOT REASONABLY FORESEEABLE BY BOTH PARTIES AT THE TIME OF ENTERING INTO THIS AGREEMENT.
THE COMPANY'S TOTAL AGGREGATE LIABILITY TO THE CUSTOMER IN RESPECT OF ALL CLAIMS ARISING UNDER OR IN CONNECTION WITH THIS AGREEMENT SHALL IN NO EVENT EXCEED THE TOTAL FEES ACTUALLY PAID BY THE CUSTOMER TO THE COMPANY DURING THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
NOTHING IN THIS AGREEMENT SHALL OPERATE TO EXCLUDE OR LIMIT THE COMPANY'S LIABILITY FOR FRAUD, FOR DEATH OR PERSONAL INJURY CAUSED BY ITS NEGLIGENCE, OR FOR ANY OTHER MATTER IN RESPECT OF WHICH LIABILITY CANNOT LAWFULLY BE EXCLUDED OR RESTRICTED.
11. Notification Procedures
The Company endeavours to keep customers informed at all relevant stages of account activity. Where reasonably practicable, the Company will notify the customer by email or telephone prior to taking any action on their account, and will clearly communicate the nature of the issue and the steps available for resolution.
In cases involving serious violations of this Agreement, security threats, or unlawful activity, the Company reserves the right to suspend or terminate an account immediately and without prior notice, where necessary to protect the integrity of its platform or the interests of other customers.
While the Company makes every reasonable effort to deliver renewal reminders and important account notifications, the delivery of email communications cannot be guaranteed and may be affected by factors beyond the Company's control. The customer remains solely responsible for monitoring domain renewal dates and maintaining current billing and contact information at all times.

12. Force Majeure
In accordance with Articles 1791 and 1792 of the Ethiopian Civil Code (1960), the Company shall not be liable for any failure or delay in the performance of its obligations under this Agreement where such failure or delay results from an occurrence which the Company could not normally foresee and which prevents it absolutely from performing its obligations. Such occurrences include, without limitation, acts of God, natural disasters, fire, flood, earthquake, epidemic or pandemic, war, terrorism, civil unrest, government action or regulation, power failures, internet or telecommunications outages, or failures of third-party infrastructure providers.
In the event of a force majeure occurrence, the Company's obligations under this Agreement shall be suspended for the duration of the event. The Company will make reasonable efforts to notify affected customers and to restore services as promptly as practicable.

Acceptance of Terms
By using HahuCloud's services, accessing our platform, or completing a purchase, you confirm that you have read, understood, and agree to be legally bound by this Agreement. If you do not agree to these terms, you must not use our services.
